Señor presidente:
El Decreto 377/2008 Poder Ejecutivo Nacional, del 5 de marzo de 2008, establece la transferencia del Comité Federal de Radiodifusión (COMFER) como organismo descentralizado, dependiente de la Secretaría General de la Presidencia de la Nación, a la Secretaría de Medios de Comunicación de la Jefatura de Gabinete de Ministros.
La Secretaría de Medios de Comunicación cuenta, bajo su órbita, a la Agencia de Noticias Télam Sociedad del Estado, y por lo tanto le compete entender, entre otros temas, en las decisiones vinculadas al otorgamiento de la pauta de publicidad oficial. A su vez depende de ella también el Sistema Nacional de Medios Públicos, Sociedad del Estado del que dependen Canal 7 y Radio Nacional.
En tanto el COMFER, como un organismo autárquico del Estado Nacional, es responsable de regular, controlar y fiscalizar la instalación y funcionamiento de las emisoras de radio y televisión en todo el país.
Resulta por lo tanto un serio contrasentido promover la concentración de áreas como la que posee el manejo de la pauta de publicidad oficial con la que ejerce el otorgamiento de licencias de radiodifusión, su regulación, control y fiscalización.
Es importante resaltar que justamente la Secretaría que debe articular la relación del Gobierno con los medios de comunicación, reciba ahora la competencia nueva de controlarlos. En un principio administrativo que favorece la transparencia se suele señalar "el que habilita/autoriza no controla" por lo que no es una buena medida concentrar en la misma área la relación institucional con los medios y el control de su funcionamiento.
Es cierto que en materia de radiodifusión, el Poder Legislativo se encuentra aún hoy en deuda con la sociedad Argentina, puesto que se mantiene vigente la Ley 22.285 de la Dictadura Militar que fija los objetivos, las políticas y las bases que deberán cumplir los servicios de radiodifusión en nuestro país, más allá de los infructuosos esfuerzos que realizamos varios Legisladores por modificarla.
También es cierto que esos esfuerzos han significado, en tiempos de democracia, al menos promover desde este Parlamento reformas parciales a la Ley de la Dictadura, algunas significativas como la reforma promovida por la Ley 26.053 al Art. 45 de la 22.285, otras también significativas y que perdieran estado parlamentario a pesar de haber sido aprobadas por la Cámara de Origen como lo es la modificación del artículo 96 sobre autarquía, dependencia y composición del directorio del COMFER.
La mencionada Ley 22.285 establece claramente que será el COMFER, creado también durante un gobierno dictatorial mediante Ley 19.801 del 25 de agosto de 1972, es un organismo autárquico, con dependencia del Poder Ejecutivo Nacional y la autoridad de aplicación de la Ley de radiodifusión.
La aprobación del presente proyecto, evitará a este o a cualquier otro Gobierno el manejo discrecional de los medios de información, el otorgamiento y la prórroga de licencias de radiodifusión y la distribución tendenciosa de la Publicidad Oficial.
Por otra parte, ninguna razón de mejoramiento de la administración y aprovechamiento de los recursos justifica esta concentración de poder. En tanto ese mejoramiento aludido en el decreto, también carece de sustancia, toda vez que la misma transferencia a la que se refiere el artículo segundo, comprende las unidades organizativas con sus respectivas competencias, créditos presupuestarios, bienes y personal, según reza su artículo quinto.
Este decreto debe permitirnos una profunda reflexión a los poderes del Estado y comprometernos a una definitiva discusión sobre la radiodifusión, la publicidad oficial y el acceso a la información, temas ligados a la Libertad de Prensa y Expresión y al mejoramiento de las instituciones democráticas de nuestro país.
Por los motivos expuestos solicitamos se acompañe la aprobación del presente proyecto.
